Terms of Service

Effective: Pre-launch — see notice below

Pre-launch compliance notice. HTF Market is not yet accepting alcohol payments. All alcohol transactions must be completed directly with licensed retailers. This document will be finalized with counsel before any payment functionality is enabled.

1. Acceptance of Terms

By accessing or using HTF Market (“the Platform”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.

2. Eligibility

You must be at least 21 years of age to use HTF Market. By using the Platform, you represent and warrant that you are 21 or older and legally permitted to participate in the marketplace in your jurisdiction.

3. Nature of the Service

HTF Market is a connection platform that introduces customers to licensed retailers who may have hard-to-find products available. HTF Market is not a retailer, does not sell, ship, or deliver alcohol, and does not collect payment for alcohol sales. All transactions are completed directly with licensed retailers in compliance with applicable state and local laws.

4. Offer Requests and Listings

Customers may submit offer requests for products. Licensed retailers may respond with offers or post pickup listings. Acceptance of an offer or confirmation of interest in a listing does not constitute a binding sale. Final availability, pricing, and sale terms are confirmed directly with the licensed retailer in person.

4a. Claim Pass Fees and Memberships

HTF Market may charge fixed fees for software and access services — including Claim Passfees to unlock an Accepted Match, customer memberships, and retailer software subscriptions. These are HTF Market's own service fees. They are not a deposit, alcohol payment, coupon, or stored value for alcohol, are never applied toward the price of a bottle, and are never a percentage of or commission on a bottle sale. No alcohol payment is collected by HTF Market. See the Claim Pass Terms and Refund Policy for details.

5. User Conduct

You agree not to: (a) misrepresent your identity or age; (b) submit fraudulent offer requests; (c) attempt to circumvent retailer licensing requirements; (d) use the Platform for any unlawful purpose; or (e) interfere with the operation of the Platform.

6. Account Termination

We reserve the right to suspend or terminate your access to the Platform at any time, for any reason, including violation of these Terms.

7. Disclaimers

HTF Market is provided “as is” without warranties of any kind. We do not warrant the accuracy of listings, retailer availability, or product authenticity. Authenticity and availability are the responsibility of the licensed retailer.

8. Limitation of Liability

To the maximum extent permitted by law, HTF Market shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform.

9. Changes to Terms

We may update these Terms from time to time. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
